The Simple Guide.to Real Estate
Curated by Justin Baarts
You might have heard the news about the BC government making suites legal across the province. While this is great for houses, it doesn't always work for townhomes. In Kelowna, the zoning bylaws can override these changes.
If your City of Kelowna zoning bylaws say "no" to secondary suites, the new provincial laws won't help you. Most strata complexes in the Okanagan ban suites to prevent parking issues and keep insurance costs low.
The Three "Dealbreakers" for Townhome Suites
Before you call a contractor, you need to check these three things:
The Bylaws: You must read the "Form B" and the Strata Bylaws. If they forbid a second kitchen, your project is over before it starts.
Fire Safety: Building code for townhomes is much tougher than for houses. You need thick fire-rated walls and ceilings between you and the tenant. This can cost tens of thousands of dollars.
The Parking Rule: The City of Kelowna requires a dedicated parking spot for a suite. Most townhomes only have room for two cars. If you can't fit a third car off the street, you won't get a permit.

The "In-Law" Suite Loophole?
Many owners try to build a "wet bar" instead of a kitchen. In Kelowna, the moment you add a stove or a 220V outlet for an oven, it becomes a suite. If you get caught without a permit, the city can force you to rip it out. With that cost going directly to you, the owner.
If you are buying a home specifically to rent out a suite, a townhome is usually the riskiest choice in our market.
How to Find a "Suite-Ready" Property
| Property Type | Suite Potential | Ease of Permit |
| Detached House | High | Simple |
| RU6 Zoned Lot | Very High | Direct |
| Strata Townhome | Low | Very Difficult |
The Strategist’s Move
Don't guess on the bylaws. I can pull the strata documents for any complex in Kelowna and tell you exactly what is allowed. We look for specific wording that allows "Secondary Suites" or "Mortgage Helpers" before you put an offer in.
FAQs.
What is the difference between an "In-law" and a "Legal Rental Suite"?
It comes down to the stove. A "Guest Suite" or "In-law Suite" usually lacks a full kitchen (no 220V outlet for a stove). You can have a sink, a small fridge, and a microwave. However, you cannot legally rent this out as a separate dwelling. A Legal Rental Suite requires a building permit, a fire-rated separation, a separate entrance, and a dedicated off-street parking stall.
Does the new BC "Small-Scale Multi-Unit Housing" law mean I can add a suite to my townhome?
While the new BC laws (Bill 44) allow up to four units on many single-family lots, they do not automatically override Strata Bylaws. If your townhome is part of a strata, the corporation’s rules about secondary suites still apply. Most strata complexes in Kelowna specifically forbid second kitchens to keep insurance costs down and prevent parking overloads. As well, Kelowna zoning bylaws prohibit secondary suites in most townhome complexes.
Can I Have a Roommate in My Kelowna Townhome?
The short answer: yes, in almost every case. While building a separate, legal suite in a townhome is very difficult, having a roommate move into your spare bedroom is a completely different story. Thanks to changes in the BC Strata Property Act, your strata has very little power to stop you from having a roommate.
